[ARCHIVED] Driver found passed out, arrested for felony DWI

According to Sheriff Jeffrey J. Murphy, on April 22, 2016 at 8:36 pm, the Washington County Sheriff’s Office responded to the area of Broad Street and Ninth Avenue in the Town of Kingsbury for a report of an erratic driver who had stopped and appeared slumped over at the wheel.

Upon arrival, sheriff’s deputies located Michael J. Marine, 49, of Ninth Avenue in Kingsbury, passed out at the wheel of his 2003 Jeep Liberty.

Marine appeared intoxicated and failed initial field sobriety tests before refusing to finish further testing. He was arrested and transported to the Law Enforcement Center in Fort Edward where he was processed and refused a breath test to determine his blood alcohol content.

Marine was charged with felony driving while intoxicated and refusal to submit to a breath test. The felony count was lodged due to prior DWI convictions within the past ten years. He was arraigned and sent to the Washington County Correctional Facility for lack of $2,000 cash or $5,000 bond. The case will be forwarded to the District Attorney’s Office for possible action of the Grand Jury.
